Description

A Brazoria County Grand Jury indicted appellee, Matthew Thomas Garrett, for the three separate offenses of possession, with intent to deliver, of stanozolol (between 28 and 200 grams), cocaine (between 4 and 200 grams), and methylenedioxymethamphetamine (less than one gram). See Tex. Health & Safety Code Ann. §§ 481.114(c), 481.112(d), 481.113(b) (Vernon 2003). The State appeals from the trial courts interlocutory order granting in part appellees motion to suppress. See Tex. Code Crim. Proc. Ann. art. 44.01(a)(5) (Vernon Supp. 2004-2005). We reverse the order of the trial court and remand the cause with instructions for the trial court to enter an order denying that portion of the suppression motion that it previously granted.
